Please read these Terms of Service carefully before using AvocadoClock. By accessing or using our service, you agree to be bound by these terms. If you do not agree, do not use the service.

1. About AvocadoClock

AvocadoClock is a web-based employee time tracking and punch clock application operated by AvocadoClock, located at 2220 S Haine Dr, Harlingen, Texas 78550. You can reach us at clockavocado@gmail.com.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into contracts on behalf of yourself or your business to use this service. By using AvocadoClock, you represent that you meet these requirements.

3. Your Account

You are responsible for maintaining the security of your account credentials. You agree to notify us immediately at clockavocado@gmail.com if you suspect unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.

You are responsible for all activity that occurs under your account, including activity by your employees who access the service through your account.

4. Subscription and Billing

AvocadoClock offers a 14-day free trial. No credit card is required to start the trial. After the trial period, continued access requires a paid subscription.

Subscriptions are billed monthly. You authorize us to charge your payment method on file at the start of each billing cycle. All fees are non-refundable except as required by law or as stated in our refund policy.

We reserve the right to change pricing with 30 days advance notice. Continued use after a price change constitutes acceptance of the new pricing.

5. Free Trial

Your 14-day free trial begins on the date you create your account. At the end of the trial period, your account will enter a 3-day grace period. If no payment method is added during the grace period, access to your account will be suspended until a valid payment method is provided.

6. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to your account until that date. We do not provide refunds for partial billing periods.

7. Your Data

You retain ownership of all employee data, punch records, and other content you input into AvocadoClock. We do not sell your data to third parties. See our Privacy Policy for details on how we handle your data.

Upon cancellation or account termination, you may export your data before your access ends. After account termination, we may delete your data after a reasonable retention period.

If you enable the geofencing feature, employee location data is collected at the time of each clock-in. You are responsible for informing your employees that location data is being collected and obtaining any required consents under applicable law. AvocadoClock stores this data to display distance information in your admin dashboard.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for any loss or damage resulting from service downtime, data loss, or service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, AvocadoClock shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from your use of the service. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be error-free, secure, or meet your specific requirements.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Hidalgo County, Texas.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the application. Continued use of the service after changes are posted constitutes acceptance of the updated Terms.
